Ponsseshop.com Terms of delivery

Valid from 1 February 2024.

1. Scope of application

These terms of delivery of the online Ponsseshop.com shop (hereinafter “the Terms”) apply to www.ponsseshop.com website and shop maintained by Ponsse Plc, and orders and purchases of products available in the online shop. In all purchases made from the online shop, the seller is:

TO ORDER PRODUCTS FROM THE ONLINE SHOP, YOU MUST FIRST ACCEPT THESE TERMS. By accepting these Terms, you also understand that we may send you emails and/or text messages related to your orders.

We reserve the right to make changes to these Terms at any time. Revised Terms apply to orders placed on the date when the new Terms enter into force or later. These Terms do not restrict consumer customers’ statutory rights.

2. Product orders and customer relationships

Private individuals of at least 18 years of age and companies can place orders in the online shop. To order products from the online shop, add them to the shopping cart and pay their price. The order process allows you to check your order before shipping. The customer and seller enter into an agreement when the seller confirms the customer’s order by email.

The following mandatory information (*) is required from customers when placing orders:

  • Country*
  • The company’s VAT code
  • State/province
  • City/town*
  • Telephone number*

All approved orders will be confirmed by email, indicating

  • the order number
  • the products ordered
  • the total price of the order/invoice with tax

Customers can create a customer account after the checkout/payment stage. Customers can also check the content of their order in their customer/user account when placing orders if they have logged in to their account.

Data about the online shop’s customers is saved in the customer register of Ponsse’s online shop. Your personal data is processed in accordance with the register’s privacy policy available at https://www.ponsseshop.com/en/privacy-statement

Customers can also check their data in their customer account if they have created an account and also refuse the use and processing of their data for marketing purposes.

3. Product range

Before ordering products, make sure that they are suitable for the intended purposes. You can use the product information available in the online shop to ensure this. If the content of the online shop differs from information provided on another website or in another source, the information available in the online shop at the time of the purchase will apply. The seller is not responsible for the suitability of products for your specific purposes of use.

We can change product descriptions at any time without any separate notification at our discretion. We reserve the right to interrupt or stop the sale of any product without any liability or advance notification.

4. Pricing

The price indicated in the online shop at the time of the purchase will be charged for each product. The price is shown in the order information before the payment stage and confirmed in the order confirmation. If the price indicated in the online shop is incorrect due to a typing error or another apparent mistake, the incorrect price will not be binding on the seller.

When using a discount code, the reduced price will be shown in the order information before the payment stage once you have entered the code.

We reserve the right to change the prices indicated in the online shop without any advance notification. Changed prices apply to orders placed after the entry into force of the relevant change.

The product prices indicated in the online shop include value added tax and other applicable taxes but not delivery costs. Delivery costs are shown in the order information before the payment stage. An up-to-date list of delivery methods and related delivery costs is available at https://www.ponsseshop.com/en/delivery-information. You can check the delivery costs of your order after you have selected the payment and delivery method in the shopping cart.

5. Payment methods and payment service providers

You can pay your purchase using the specified purchase methods in Ponsseshop.com. Items and their delivery costs are paid for together with an order.

An up-to-date list of applicable payment methods and their applicable terms is available in the online shop. In terms of invoicing or part payment the seller or their cooperation partners can acquire your credit report from a third party. In such case you will receive a notification. The seller reserves the right to abstain from offering all payment methods at all times or alternatively suggest a change of payment method if the payment method of your choice is not applicable for a reason while fulfilling the order.

Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

6. Deliveries

We deliver products from the online shop to Mainland Finland, the European Union and Switzerland. We only deliver products to home and company addresses. Poste restante and similar addresses are not accepted.

Ordered products are normally delivered within 2–5 working days of the order. Please note that busy seasons and public holidays may have an impact on the delivery time. A link to track your order will be sent by email when your order is ready for delivery.

7. Product errors

For consumer customers, we are liable for any errors in the products we have delivered in accordance with chapter 5 of the Consumer Protection Act. The seller is not responsible for any errors caused by the incorrect handling of a product, normal wear and tear, or neglected installation, operating or maintenance instructions.

If you receive a faulty or incorrect product or if some of the ordered products are missing from the delivery, please contact our customer service (ponsseshop@ponsse.com) as quickly as possible after detecting the error and no later than 14 days after receiving the delivery. However, consumer customers can always submit a notification of an error within two months of having detected the error.

If a product we have delivered is found to be faulty, we will fix the error, deliver an appropriate replacement product or, if neither of these is possible, pay compensation equalling the proportion of the error from the price without any delay. If a customer complaint results in a product return, we will be responsible for any expenses arising from returning the product.

8. Right of cancellation

We provide our products with a 30-day replacement and return right. You also have the right to have the products you have ordered replaced by products of different sizes free of charge. If you return a full order, we will refund the product price and delivery costs. We only accept the return of products purchased from the online Ponsseshop.com shop. This replacement and return right does not restrict the right of consumer customers to cancel a distance selling agreement by notifying the seller of it using the cancellation form or by other unambiguous means no later than 14 days after receiving the products. Returning or not picking up a product is not sufficient – customers must always submit a separate cancellation notification. Please follow the more detailed instructions available at https://www.ponsseshop.com/en/returns when returning products.

If a customer cancels a transaction, they must return the product received immediately and no later than 14 days after submitting their cancellation notification. Product returns are free of charge for customers for orders placed from Mainland Finland. For orders placed from locations other than Mainland Finland, customers will be responsible for product return costs.

When a customer cancels their online shop order, the seller will refund the payment made with delivery costs without any delay and no later than 14 days after receiving the cancellation notification using the payment method the customer used in the original payment transaction, unless otherwise agreed with the customer. However, the seller has the right to not refund any payments until the seller has received the returned product or the consumer customer has proven that they have returned the product (e.g. using the return receipt).

Customers are always responsible for any decreases in the product value. The seller has the right to deduct an amount equalling any decrease in the product value from the refunded amount. If a product has become wholly unsaleable after it has been used, the seller can refuse to refund the amount paid. If a customer wishes a product to be resent, the customer will be responsible for the arising transport costs.

9. Force majeure

The seller is not responsible for any delays or losses that result from conditions which are outside the seller’s scope of influence and the seller cannot have reasonably taken into account when entering into an agreement, and the impact of which the seller cannot have reasonably avoided or overcome. Force majeure situations include armed conflicts and military operations, terrorist attacks, natural disasters, pandemics, industrial actions, fires, cyberattacks and malfunctions in data connections. If there is a force majeure situation, the seller must issue a notification when it starts and ends. The customer and seller can cancel an order placed in the online shop with immediate effect if a force majeure situation has continued for more than two (2) months.

10. Limitations of liability

The seller’s liability is limited to the tax-exempt price paid for products purchased from the online shop within the scope permitted by mandatory legislation, and the seller is not responsible for any indirect losses. The limitations of liability will not apply if liability is based on the seller’s intent or gross negligence. The seller’s liability for errors is limited to the liability defined in mandatory legislation. The seller does not provide any guarantees or assurances in excess of mandatory legislation.

11. Links to third-party websites

The online shop may include links to third-party websites or services. Even if a third party was linked to the seller, we cannot have any impact on these websites or services, each of which has separate terms or use and/or data protection and collection practices independent of the seller. These linked websites and services will only be provided to support your use of the online shop. This means that you use them at your own risk.

12. Applicable law adn the settlement of disputes

These Terms, the online shop and purchases made in the online shop are governed by Finnish law, unless otherwise defined in mandatory legislation.

All disputes related to these Terms, the online shop and purchases made in the online shop will primarily be settled in negotiations. If no settlement can be negotiated, consumer customers can contact the Consumer Advisory Services of the Finnish Competition and Consumer Authority (https://www.kkv.fi/en/consumer-affairs/consumer-advisory-services/), after which they can request the Consumer Disputes Board (https://www.kuluttajariita.fi/en/index.html) to issue a resolution.

Consumer customers can also present disputes to Online Dispute Resolution at http://ec.europa.eu/odr. When processing cases, please use our email address (ponsseshop@ponsse.com).

In addition, customers have the right to present disputes to the district court of their domicile for a resolution or, with regard to consumer customers, to the district court of the customer’s domicile or permanent place of residence.

13. Other terms and conditions

If a competent court of law, authority or arbitration board deems any part of these Terms to be invalid or unenforceable in part of in full, other parts of the term in question and other terms will remain valid and enforceable. Any terms deemed invalid and unenforceable will be replaced by valid and enforceable terms.
